
Serving section 8 and section 21 notices simultaneously
Can both a Section 8 Notice and a Section 21 Notice be served simultaneously on the same tenant(s)? Yes. It is even advisable. There have been occasions where the Section 8 Notice is served for rent arrears where the tenant is in two months rent arrears. The tenant pays up some or all of the arrears. (This often happens). However, the landlord still wants possession of the property for other reasons not connected to a tenancy breach. If the Section 21 is served at the same time then the landlord can apply to the court for possession upon its expiry.
