Right To Rent (England Only) Update 2024
In November 2023, a new Right to Rent code of practice was issued by the Government, ahead of the higher maximum fines coming into force on January 22, 2024, for non-compliance under the Immigration Act 2014 (Residential Accommodation) (Maximum Penalty) Order 2023. The main impact of the legislative amendment is to significantly increase financial penalties on landlords and agents in England who are knowingly renting property to unauthorised migrants.
As well as the revised penalties, our article looks at the legislative changes to Right to Rent in England, including how checks can be carried out. We examine the Landlord Checking Service (LCS), which should not be confused with the Online Checking Service. We also touch upon discrimination guidance, Right to Work UK changes, and provide useful links for more information on the updated legislation.
